These Terms of Use ("Terms") govern your use of https://discountairpurifier.com (the "Site"). The Site is operated by X Enterprises, LLC, 18122 3rd Dr SE, Bothell, WA 98012 ("we," "us," or "our"). By using the Site, you agree to these Terms. If you do not agree, do not use the Site.

What the Site is, and what it is not

The Site publishes general information about air purifiers, also called portable air cleaners: how they work, HEPA and activated carbon filters, MERV ratings, the clean air delivery rate (CADR), room size, placement, portable and whole-house filtration, what drives cost, energy use, filter replacement, ozone generators and ionizers, California's air cleaner certification, wildfire smoke, DIY box fan air cleaners, and allergies and asthma. We are not a retailer, a brand, a maker, a dealer, a testing laboratory, a certification body, a government agency, a medical provider, or a lawyer. We do not sell air purifiers, filters, fans, or other products. The Site does not give prices, product picks, or cleaning, repair, or build instructions.

Important air quality and health notice

Indoor air pollutants, wildfire smoke, and ozone can harm your health, and some people, including children, older adults, and people with asthma or heart or lung disease, can be at greater risk. No air purifier or filter removes all pollutants from the air, and an air purifier is not a substitute for ventilation, for removing the source of a pollutant, or for medical care. Some air cleaners emit ozone, which can damage the lungs. Electrical devices, including fans used to build DIY air cleaners, can overheat and cause fires, burns, and other injury. You are responsible for how you choose, place, use, maintain, and replace any air purifier, filter, or fan, for following the maker's manual and instructions, and for supervising children around them. If you have symptoms or a health condition, talk to your doctor. During a wildfire, follow local officials and be ready to evacuate. In an emergency, call 911.

General information only; no medical, professional, legal, or safety advice

Content on the Site is for general information. It is not medical, health, legal, regulatory, engineering, electrical, safety, or professional advice, and it is not a substitute for your doctor, a qualified HVAC technician, the maker's manual, or a qualified professional. Do not use the Site to diagnose or treat any condition, or to delay getting medical care. We do not say that any air purifier, filter, fan, or practice is safe or effective for you, or that it will improve your health, and nothing on the Site is a test, rating, inspection, or certification of any product.

Ozone, ionizers, and electronic air cleaners

Where the Site describes ozone generators, ionizers, electrostatic precipitators, ultraviolet (UV) lights, plasma, or photocatalytic oxidation devices, it does so as the U.S. Environmental Protection Agency (EPA) and the California Air Resources Board describe them, for general information. The Site does not recommend any device that produces ozone, and it does not say that any product emits little or no ozone.

Wildfire smoke and emergencies

Where the Site describes wildfire smoke, clean rooms, or air cleaner use during smoke events, it does so as EPA and AirNow describe them. Conditions can change quickly. Local officials and emergency alerts come first. The Site is not a source of emergency information or current air quality conditions.

Filters, cleaning, and electrical safety

The Site does not give cleaning, repair, wiring, or DIY build steps. Unplug any device before you open it, and follow the maker's manual for filters and cleaning. Where the Site describes DIY box fan air cleaners, it repeats EPA's own guidance and safety tips and links EPA's pages. EPA recommends using DIY air cleaners only when products of known performance are not available or affordable. If you build or use one, you do so at your own risk, and you are responsible for following EPA's guidance and the fan maker's instructions.

Makers' manuals and instructions

Air purifiers, filters, fans, and accessories are made and sold by third parties under their own terms. Their manuals, instructions, warnings, and labels control over anything on the Site. We have not tested any product. We are not responsible for any third party's products, claims, manuals, instructions, or recalls.

Federal and state programs, standards, and labels

Where the Site describes the U.S. Department of Energy standard DOE-STD-3020-2015, EPA guidance, ENERGY STAR, the California Air Resources Board's air cleaner regulation and label, the MERV rating, or the ANSI/AHAM AC-1 voluntary standard, it does so as those agencies or EPA state them, for general information only. DOE-STD-3020-2015 is written for HEPA filters used in DOE nuclear facilities. The Site does not say that any federal rule defines, tests, or certifies HEPA filters in home products. The Site does not reprint standards, does not say that any product meets, passes, or is certified or verified to any standard or program, and does not tell you what the law requires. Rules change, and other federal, state, local, and foreign laws may apply. If you make, import, sell, or install air cleaners, read the current rules, including the California Air Resources Board's regulation, and get advice from a qualified professional about your situation.

Agencies, organizations, and sources

Government agencies and organizations named on the Site, including EPA (with its ENERGY STAR program and the AirNow website), the U.S. Department of Energy, the California Air Resources Board, ASHRAE, and the Association of Home Appliance Manufacturers, are credited for their own guidance and definitions. Underwriters Laboratories (UL) and Intertek (ETL) are named only as EPA names their fan safety markings. None of them endorses the Site, and the Site's mention of a standard, program, list, label, marking, or source is not a statement that any product is approved, certified, compliant, effective, or safe.

Cost information and the Site name

"Discount Air Purifier" is the name of the Site. It is not a statement that any air purifier is discounted, cheap, low priced, on sale, or a good value, and it does not mean that we sell air purifiers or offer deals, discounts, or coupons. The Site does not list prices. Where it describes cost, it describes what drives cost as a named source states it, without figures. Prices, features, and availability are set by retailers and makers and can change.

Brand names and trademarks

Brand, product, program, and organization names mentioned on the Site belong to their owners. We use them only to credit their own guidance. The Site is not affiliated with, sponsored by, or endorsed by any brand or organization it mentions.

The Site is for a general audience. It is not directed to children under 13.

Acceptable use

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE AND OUR OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE, ANY PURCHASE FROM A THIRD PARTY, ANY DECISION ABOUT YOUR HEALTH, OR THE SELECTION, USE, PLACEMENT, MAINTENANCE, OR CONSTRUCTION OF ANY AIR PURIFIER, AIR CLEANER, FILTER, FAN, OR OTHER DEVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SITE OR THESE TERMS WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100). NOTHING IN THESE TERMS LIMITS LIABILITY THAT CANNOT LAWFULLY BE LIMITED.

Indemnification

You will defend, indemnify, and hold us harmless from claims, losses, and expenses (including reasonable attorneys' fees) arising from your misuse of the Site or your violation of these Terms.

Dispute resolution; binding arbitration; class-action waiver

Please read this section carefully. Except for small-claims matters and claims for injunctive relief over intellectual property, any dispute about these Terms or the Site will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. The seat of arbitration will be King County, Washington, unless you and we agree otherwise. You and we waive any right to a jury trial and to take part in a class, consolidated, or representative action. If the class-action waiver is found unenforceable for a claim, that claim must proceed in court and not in arbitration.

Governing law and venue

These Terms are governed by the laws of the State of Washington, without regard to conflict-of-law rules. Subject to the arbitration section, exclusive venue for permitted court actions is the state or federal courts in King County, Washington, and you consent to jurisdiction there.

Assignment and change of operator

We may assign or transfer these Terms, and the Site, to a successor operator, including as part of a sale of the Site, without notice to you. After that, the successor operator takes our place under these Terms and may post its own terms. You may not assign these Terms without our written consent.

Changes

We may update these Terms by posting a revised version on this page with a new "Last updated" date. Continued use after that date means you accept the revised Terms.

Miscellaneous

These Terms, with the Privacy Policy and Affiliate Disclosure, are the entire agreement between you and us about the Site. If any provision is unenforceable, the rest remain in effect. Our failure to enforce a provision is not a waiver.
